Terms of Use and Privacy Policy

These Terms of Use and Privacy Policy (“Terms”) govern your access to and use of the public website and private member portal provided by the Sleepy Hollow Manor Association, Inc. (“SHMA”), which are accessible at www.shmanor.org (collectively, the “Site”).

By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree to the Terms, you must immediately terminate use of the Site.

MEMBER ACCOUNT & SITE CONTENT

  • To access the private member portal, you must maintain active membership and obtain login credentials. You are solely responsible for maintaining the confidentiality of your username and password. You agree to notify SHMA immediately in case of unauthorized use of your account. SHMA is not liable for any loss or damage arising from your failure to safeguard your credentials. SHMA reserves the right to suspend or revoke access to the private portal at any time if a member violates these Terms or loses membership status.
  • Members may submit or modify basic information regarding their households and vehicles. You represent and warrant that all information provided to the Site is accurate, current, and pertains solely to your household. 
  • All original content, branding, logos, graphics, and organizational materials created by SHMA and made available on the Site are the exclusive property of SHMA and are protected by applicable intellectual property laws. You may not reproduce, distribute, or modify SHMA intellectual property without prior written consent.
  • Members may also upload photos (“User Content”) to the Site (e.g., from SHMA-sponsored events). By uploading User Content, you warrant and represent that you either own or otherwise control all of the rights to that content, including, without limitation, all the rights necessary for you to submit the content, and you grant SHMA a non-exclusive, royalty-free, perpetual, and worldwide license to display, reproduce, and distribute such content solely for SHMA-related purposes. You agree not to upload any photo or content that infringes upon the copyright, trademark, or privacy rights of any third party or contains illegal, vulgar, defamatory, or inappropriate material. SHMA reserves the right, but assumes no obligation, to review, moderate, or permanently delete any User Content at its sole discretion, without notice.

MEMBERSHIP PAYMENTS & THIRD-PARTY PROCESSING

  • Membership dues can be paid via the Site. Membership dues are paid on an annual basis. Dues are not pro-rated, nor are refunds available, for partial year membership.
  • Any payments submitted via the Site are processed through Stripe, a secure third-party payment processor (“Processor”). SHMA does not collect, store, process, or maintain full credit card, debit card, bank account numbers or other raw personal financial data. All payment transactions are subject to the terms and policies of the Processor. You acknowledge and agree that SHMA is not liable for any losses, errors, processing failures, technical outages, or fees (including transaction or currency conversion fees) caused by the Processor.

NO WARRANTIES, THIRD-PARTY CONTENT, & INDEMNIFICATION

The Site and the information and other material available on or accessible from the Site is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose. SHMA does not warrant that service to the Site will be uninterrupted or error free or that any information or other material available on or accessible through the Site is free of viruses, worms, Trojan horses or other harmful components.

SHMA frequently relies on information provided by, may make available material from, and may provide links to external sources (e.g., the Village of Sleepy Hollow). SHMA does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or external materials. Accessing third-party resources is done entirely at your own risk. SHMA makes no warranty or guarantee concerning the accuracy or reliability of such information or other linked sites. 

Under no circumstances shall SHMA, or its directors and officers, be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of or inability to use the Site or your reliance on or use of information or services provided on or accessible through the Site, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance.

You agree to defend, indemnify and hold SHMA harmless from any and all liabilities, costs and expenses, including reasonable attorney’s fees, related to any violation of these Terms or submission of User Content by you.

PRIVACY POLICY

SHMA only collects and maintains basic information necessary to manage your membership and SHMA activities, which information is obtained directly from you as party of the membership enrollment process. This information includes the following:

  • Full name
  • Email address
  • Mailing address
  • Phone number
  • Information on vehicles for parking sticker purposes (e.g., make/model, license)

SHMA uses this basic information strictly for SHMA purposes, including:

  • Managing your membership account, status and renewals
  • Sending SHMA updates, notices, and event invitations
  • Maintaining SHMA’s parking sticker program

SHMA does not sell, rent, or trade your personal information with outside marketers or third parties. SHMA only shares your data with trusted services required to run SHMA, such as the website host, email platform, and Stripe for payments. You can review, update, or correct your personal information at any time by logging into your member account or by contacting SHMA directly. If you wish to cancel your membership and have your information removed from SHMA’s active database, please contact SHMA using the Contact Us form available on the Site.

MISCELLANEOUS

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms or the Site shall be instituted exclusively in the state or federal courts located in New York.

These Terms are subject to amendment or modification at any time. Updated versions will be posted on the Site with a revised “Effective Date”. Continued use of the Site following any changes constitutes your acceptance of the updated Terms.
